We have succeeded in establishing violations of domestic human rights law on behalf of provisions facing death penalty in Kenya in the case of Godfrey Ngotho -vs- Republic.

The decision has effectively limited the instance in which death penalty can be imposed or carried out on those charged with and convicted of murder in Kenya. By holding that Section 204 of the Penal Code which provides for mandatory death sentence in Kenya is authentical to the Constitutional provisions on protection against human or degrading punishment or treatment and fair trial, the Court of Appeal mandatory death sentence on all prisoners convicted of murder.

Such prisoners will now have the right to be heard on mitigation and the trial court will have the discretion to pass sentence that is proportionate having due regard to the circumstances of both the offence and the offender. In the aforesaid case we worked together with:-

Mr. Timothy Bryant and were assisted by
Staff of CLEAR Trust and team of United Kingdom lawyers comprising of
Mr. Saul Lehrfreund MBE and
Mr. Parvai Jabbar (Executive Director of the Death Penalty Project) and Mr. Joseph Middleton of Doughty Street Chambers.

We have also worked with CLEAR Trust in the provision of legal aid to various communities within Mombasa and apart from taking up matters in court on pro bono basis have continually provided free legal education in the following topics:-

We have also worked together with National Legal Aid & Awareness Programme (NALEAP) in the provision of free legal aid in Mombasa.
